June 9 Marks 5 Years Since the Passage of NV SB 409
After seeing one unreportable criminal conviction after another in the state of Nevada, AmericanChecked President, Julie Hakman, decided enough was enough. Employers weren’t receiving critical information about applicants that could potentially put their employees, clients and guests in danger. At the time, the laws in Nevada only allowed criminal convictions to be reported up to 7 years. In comparison, most states allow all conviction information to be reported in a background check report.
Julie spearheaded the legislative effort, along with attorney Tony Cabot, partner at Lewis Roca Rothgerber, and sponsored by then-Senator Mark Lipparelli that would result in the passage of Nevada Senate Bill 409 which closed the loophole on reportable information. Essentially, the bill allows ALL employers to conduct more thorough background checks on prospective employees.
With the introduction of Nevada Senate Bill 409, a consumer reporting agency is no longer prohibited from reporting criminal convictions older than 7 years to all employers and reporting information to gaming licensees about a job applicant regarding bankruptcies older than 10 years and other civil judgments older than 7 years.
